Youtube Video: The Mediation Process

All

I am always on the lookout for videos that can help demonstrate for those new to mediation what the process looks like.  The following video is a good one.  In just under eleven minutes it takes you through a traditional four stage mediation process model: mediator's opening statement, discussion of issues and interests (storytelling), options generation (problem solving), reaching agreement (memorandum of understanding).

The video is not perfect.  The dispute being mediated is a family matter and the entire mediation demonstration takes place in a joint session, with the mediator and the parties and their counsel present throughout. I recognize that other disputes lend themselves to a combination of joint and private (caucus) meetings, depending on the unique circumstances of each case. This video does not this capture these process subtleties.

Nevertheless, the video provides a useful framework that can help those new to the mediation process become familiar with the key ground rules for discussion, the role of the mediator, the stages of a typical mediation and the roles that the parties and their counsel play at the mediation table.
